Terms of Use of the Website www.womance.ca (hereinafter the “Site”).

Preliminary Remarks
This agreement constitutes a legal contract between any person browsing or using the Site (hereinafter the “User”) and Womance Style de vie inc. (hereinafter “Womance”). If the User disagrees with the terms of this Agreement, the User must immediately cease using the Site.

1. Acceptance of Terms of Use
By using the Site, the User acknowledges that they have read, understood, and agree to be bound by these terms of use as well as any modifications that may be made from time to time (hereinafter the “Agreement”). Womance reserves the right, at its sole discretion and without prior notice, to update, modify, add, or remove provisions of this Agreement. Any such changes will be posted on this page. The User is solely responsible for periodically reviewing this Agreement to be aware of any changes that may be made. By choosing to access the Site, you agree to comply with applicable federal, provincial, and other laws and regulations. The User also agrees to comply with all terms and conditions listed herein.

2. Your Account
By ordering or purchasing products or services offered on the Site, the User may create an account. The User is fully responsible for maintaining the confidentiality and security of their account information and must not disclose this information to anyone. The User is fully responsible for activities that occur through their account and agrees to notify Womance if the security or confidentiality of their account is compromised. Womance shall not, at any time, be liable for damages or losses resulting from unauthorized use of the User’s account. The User agrees to provide complete, accurate, and truthful information when required to submit or transmit such information via the Site. The User agrees to keep this information up to date under the same terms. The User accepts that Womance may use this information to maintain billing details associated with the User’s account.

3. Intellectual Property
3.1 The trademarks and logos used or displayed on the Site are trademarks and logos registered or unregistered by Womance or third parties. Nothing on the Site shall be construed to permit, directly or indirectly, the use of such trademarks or logos without the prior written permission of their owner. Without limiting the generality of the foregoing, it is prohibited to reproduce the trademarks and logos displayed on the Site for commercial, advertising purposes, or to drive traffic to the User’s website.

3.2 All elements of the Site (including, without limitation, text, articles, photographs, images, illustrations, audio and video excerpts, software, etc.) are protected by copyright and belong to Womance or third parties acting as content providers. Except as expressly provided, no element of the Site shall be construed as granting the User any rights regarding Womance’s or a third party content provider’s intellectual property.

3.3 Subject to the express provisions of section 3.4 below, the User may not copy, reproduce, modify, publish, broadcast, distribute, participate in the transfer or sale of, create derivative works from, translate, download, sublicense, or otherwise exploit any element offered on the Site (including any software), in whole or in part.

3.4 The User may download, publish, or copy elements of the Site for personal, non-commercial use only, provided that all intellectual property notices are retained. Copying or storing any element for purposes other than personal use is strictly prohibited without the prior written permission of Womance or the copyright holder identified in the intellectual property notice.

3.5 Content provided by the User is subject to the license and rights outlined in section 4.3 below.

4. Discussion Forums and Message Boards
4.1 Communications on discussion forums and message boards are public and not private. The User must comply with the following rules:

4.1.1 Use respectful language. Profane or offensive language will not be tolerated. Furthermore, no one shall post or submit defamatory, obscene, abusive, pornographic, injurious, or otherwise illegal content;
4.1.2 Be courteous. No one shall threaten or incite violence or hatred. It is also prohibited to deliberately disrupt discussions with repetitive, irrelevant, or spam messages;
4.1.3 Discuss, do not attack. In a forum with multiple opinions, disagreements are normal. Womance encourages civilized discussions; personal attacks violate these terms of use;
4.1.4 No one shall use message boards to promote or sell any goods or services commercially other than those available on the Site or offered by Womance, conduct or send surveys, contests, pyramid schemes, chain letters, spam, hacking, solicitation, or any other illegal acts. Acts infringing the rights of others or their enjoyment of the forums or message boards are also prohibited;
4.1.5 It is forbidden to submit or transmit any virus, bug, worm, Trojan horse, or any other harmful code or file on our sites.

4.2 The User acknowledges that they have all necessary rights, including intellectual property rights, to any material they submit to Womance as a user.

4.3 The User acknowledges and agrees that they retain copyright over any material submitted to Womance (e.g., letters to the editor, comments, etc.). By submitting material to Womance, the User grants Womance a non-exclusive, perpetual, worldwide, royalty-free license to use, edit, modify, delete, reproduce, publish, broadcast, and sublicense such material; the User waives any moral rights regarding the integrity of their work.

4.4 The User acknowledges and agrees that they are personally responsible for the content of messages posted on forums or message boards of the Site and for the consequences of those messages.

4.5 Womance reserves the right, at its sole discretion, not to publish or to remove any material submitted by a User for any of its websites, including this Site and Womance’s Facebook page. This is a discretion, not an obligation. Womance also reserves the right to report any User who violates these rules to the appropriate authorities and to delete the account of any User breaching this Agreement.

4.6 Womance makes no representations regarding control over materials available on its websites. Womance is not and cannot be held responsible for the accuracy, legality, compliance with intellectual property rules, or these terms of use of any materials provided by its Users.

5. Additional Terms Regarding Suppliers
Additional terms apply to the purchase of products and services selected by the User, including, without limitation, any privacy policy, delivery policy, and agreements governing the use of the website or services of a supplier (hereinafter “Additional Terms”). The User agrees to read and be bound by these Additional Terms. The User agrees to comply with any Additional Terms imposed by any supplier, including timely payment and adherence to supplier terms regarding product, service, and pricing availability. Suppliers may change their Additional Terms, including prices, without notice.

6. External Links
Hyperlinks on this Site may lead to third-party websites. These sites are not controlled by Womance, and Womance cannot be held responsible for the content of sites accessed via hyperlinks, for existing hyperlinks on those sites, or for any changes or updates to those sites. These hyperlinks are provided for informational purposes only, without guaranteeing quality or accuracy. Linking to the Site or Womance’s Facebook page does not imply approval or joint venture of any kind.

7. Cookies
A cookie is a small file that requests permission to be placed on the User’s computer. Once the User agrees, the file is added, and the cookie allows the analysis of web traffic or lets the User know when they visit a particular site. Cookies allow web applications to respond to the User as an individual. The application can adjust its operations according to the User’s needs by collecting and storing information on preferences. Overall, cookies help provide the User with a higher-quality Site, products, and services by tracking pages and products the User likes or dislikes. Cookies do not give Womance access to the User’s computer or any other information, other than data voluntarily shared.

The User may choose to accept or reject cookies. Most web browsers automatically accept cookies, but the User can usually change browser settings to refuse cookies, though this may prevent full use of the Site.

8. Limitation of Liability
The Site, including its content and services, is provided “as is” without any express or implied warranty. Information, software, products, and services on this Site may contain inaccuracies or errors, including pricing errors. In particular, Womance and its affiliates do not guarantee accuracy and disclaim any liability for errors regarding information and descriptions of products and services offered or displayed on the Site. Womance expressly reserves the right to correct any pricing errors on the Site and/or for ongoing purchases or orders made at an incorrect price.

Without limiting the generality of the foregoing, in no event shall Womance, its affiliates, or their respective suppliers be liable for direct, indirect, punitive, incidental, special, or consequential damages arising from or related in any way to the User’s access or use of this Site, whether based on negligence, contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.

9. Indemnification
The User agrees to defend and hold harmless Womance, its directors, officers, executives, shareholders, employees, affiliates, representatives, and content providers (collectively, “Womance” for the purposes of this Section 9) from any monetary judgments, interest, legal and extrajudicial fees, and any other damages, including but not limited to reasonable legal fees incurred by Womance relating to any claim, lawsuit, action, or demand (“Claim”) arising from:

i) any content submitted, posted, or transmitted by the User on the Site;
ii) the use by the User or any person using the User’s account, authorized or not, of the Site, connection to it, or any other violation of this Agreement;
iii) any violation of applicable laws or third-party rights.

10. Newsletters or Other Communications from Womance
By accepting this Agreement, the User agrees to join Womance’s mailing list and authorizes Womance to send information regarding the use of the Site, products and services offered, updates, special offers, new surveys, and other relevant information. The User may unsubscribe at any time by contacting info@womance.ca and indicating they no longer wish to receive such communications. Unsubscribing does not affect the User’s obligations under this Agreement.

11. Governing Law
By using this Site, including any order or purchase, the User acknowledges and agrees that this Agreement and any Claim, lawsuit, action, or demand arising from Site use, including any order or purchase, shall be governed by the laws of the Province of Quebec and applicable federal laws of Canada. The User irrevocably submits to the exclusive jurisdiction of the courts of the Province of Quebec, judicial district of Quebec, regarding any disputes arising from this Agreement and Site use.

12. Pre-Order
Policy applicable to pre-ordering items:

You have 24 hours after placing your order on womance.ca to cancel it. By keeping your order active, you accept these terms and conditions. After this period, it will not be possible to modify or cancel your order (no changes in size or model choices). However, if you move or entered an incorrect address, you may email commandes@womance.ca, and we will happily update the address.

It will not be possible to cancel your order and request a refund before delivery to the address provided during ordering. If you change your mind, you may request a return or refund after receiving your order.

If you wish to return or exchange an item after receipt, the standard online store return/exchange policy will apply.

Womance allows a 45-day buffer following the estimated delivery period to deliver the item to your home. It is your responsibility to check delivery times for pre-order items. This period is listed here and under each pre-order product.

If the pre-order is canceled or Womance Style de vie Inc. cannot deliver the item during the pre-order, Womance agrees to fully refund your purchase, taxes, and shipping costs to your original payment method.

13. Rewards Program
It is the customer’s responsibility to enroll in the rewards program. Womance points cannot be added retroactively to prior orders. If you use your rewards and return your items, points cannot be regained. A limit of 10 product reviews is allowed every 30 days to earn up to 250 points. You may continue reviewing products afterward, but no reward points will be issued.
